In France, personal data is protected in particular by law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, article L. 226-13 of the Criminal Code and the European Directive of 24 October 1995.

9. Applicable law and jurisdiction.

Any dispute relating to the use of the homexpo.paris website is subject to French law. The competent courts of Paris have exclusive jurisdiction.

I/ IDENTIFICATION OF THE CONTROLLER

Mr François Demoor, is the data controller and therefore assumes, as such, responsibility for the collection and management of its users’ personal data in accordance with the provisions of Regulation (EU) No. 2016/679 of 27 April 2016 on the protection of personal data.

II/ THE DIFFERENT CATEGORIES OF PERSONAL DATA COLLECTION

1/ The compulsory nature of the data requires the user to accept the collection of his or her data to enable TULIP IMMO to provide its services. On the site, in the data collection forms, the user is informed of the mandatory nature of the collection.

2/ The collection of personal data may be optional. In this case, the user’s consent becomes mandatory. In the absence of consent, TULIP IMMO will not be able to use the user’s data outside the scope of its services as described below.

3/ TULIP IMMO may also, in accordance with the law, have a legitimate interest in collecting data. In this case, consent is not required.

III/ THE PURPOSES OF THE COLLECTION

3.1 – Collection is optional for all marketing and advertising operations that may be set up by TULIP IMMO, in particular newsletters, promotional or commercial offers targeted by email, telephone, on social networks or other media, for offers from its commercial partners,

3.2 – Except in the case of the user’s express refusal to be the subject of canvassing messages, TULIP IMMO has a legitimate interest in collecting data without any consent for the following purposes:

  • For the management of the services offered by the site;
  • To manage user satisfaction;
  • To carry out statistical, analysis and segmentation operations in order to improve knowledge of users
  • To analyse, adapt and improve the content of the Site;
  • To allow the User to receive messages;
  • To facilitate the provision and use of the Site;

V/ THE DIFFERENT COLLECTION METHODS USED

The data can be collected either through the active intervention of the user or automatically.

The data is collected through the active intervention of the user when he/she fills in a form and therefore transmits his/her identification data.

Other data, such as the date and time of access to the Site, the pages consulted or location data, are collected automatically, through the servers consulted and the “cookies” placed on the site according to the procedure described in the legal notice.

VI/ THE RECIPIENTS OF THE DATA

Personal data is intended for TULIP IMMO and all of its partners and subcontractors in charge of managing the maintenance, hosting, evolution and optimization of the site, the management of marketing and promotional campaigns, as well as for all administrative and legal authorities that may be directly concerned or at their request.

All TULIP IMMO employees and subcontractors required to provide the services have access to the user’s personal data only to carry out their mission. Each of them is subject to a strict obligation of confidentiality and security.

VII/ TRANSFER OF DATA OUTSIDE THE EU

Data is not transferred to a country outside the EU for the purposes described above to subcontractors or their subcontractors.

VIII/ THE LENGTH OF TIME THE DATA IS KEPT

As regards compulsory collection, the data is kept for the time required to provide the services or for the time required by the various legal requirements, particularly in tax, commercial and criminal matters.

As regards optional collection, the data is kept for three years from the date of collection. This period is indicative and TULIP IMMO reserves the right to derogate from it in order to be able to respond to any questions or complaints that may be addressed to it and in order to comply with all applicable laws, in particular those relating to tax and criminal law.

IX/ SECURITY OF YOUR PERSONAL INFORMATION

TULIP IMMO undertakes to do everything in its power to ensure the confidentiality and security of the user’s data or to have these obligations carried out by the chosen subcontractors.

TULIP IMMO ensures optimal security measures against the loss, fraudulent intrusion, misuse and alteration of the information entrusted to it. All data received on the website “www.homexpo.paris” is saved daily and stored on a backup medium.

X/ THE NATURE AND EXERCISE OF USERS’ RIGHTS

The user has the following rights at all times:

  • A right of access, rectification and deletion;
  • A right to object to and delete the processing of his/her data on legitimate grounds in the case of compulsory collection or without grounds in the case of optional collection;
  • A right to the limitation of processing when the user has objected to the processing or when he/she contests the accuracy of the data or when he/she considers that the processing is unlawful;
  • A right to data portability. The user has the right to receive the personal data that he has communicated to TULIP IMMO. They can also ask TULIP IMMO to transmit this data to another data controller.

XI/ THE UPDATING AND MODIFICATION OF THE CHARTER

TULIP IMMO reserves the right to modify or adapt its Charter, in particular, in order to comply with any new legislation and/or applicable regulations, the recommendations of the CNIL, the guidelines, recommendations and good practices of the European Data Protection Committee and the decisions of the courts and tribunals on the subject. TULIP IMMO will inform users of this via the site.
